Patriot National Insurance Group utilizes experienced claims professionals to review all first reports received, and identifies claims that have the potential for a recovery from another entity. If there is an intervening accident we pursue that as well. We work closely with our insured, employer, injured worker and claims staff to ensure that we have all relevant information for a potential recovery.
We request all police reports, OSHA reports, motor vehicle accident reports, witness names and insurance coverage to gather information on location of the accident. After gathering all of the pertinent information the at-fault party, or parties, are identified and placed on notice of our intent. Policies and contracts are requested and are reviewed for hold of harmless agreements.
The recoveries amounts are based on the jurisdiction of the accident which may vary greatly from state to state. There are “made whole” states that claim that there will be no recovery, however, through negotiations we are sometimes able to obtain monies or a waiver on the workers' compensation claim. Other states have a formula that is used to calculate the recovery based on the settlement amount from the third party. There is also arbitration that is utilized when the parties are unable to come to an amicable agreement.
